1. About These Terms
These terms describe how Territory Sellers (ABN 83 853 672 482) provides its consignment sales service. By consigning an item with us, you agree to these terms together with the specific details (minimum sale price, commission and any fees) agreed with you for your item. Nothing in these terms excludes any rights you may have under the Australian Consumer Law.
2. The Consignment Arrangement
- Territory Sellers acts as a consignment sales service, marketing and selling items on behalf of their owners.
- We handle the advertising, enquiries, negotiations and sale process on the owner's behalf.
- The owner sets an agreed minimum sale price before the item is listed. The item will not be sold below this agreed minimum.
3. Ownership
All items remain the property of the owner until sold. Consigning an item with Territory Sellers does not transfer ownership to us; it authorises us to market and sell the item on the owner's behalf on the agreed terms.
4. Commission and Fees
- Once an item is sold, the owner receives the agreed amount, and Territory Sellers retains the agreed commission and any applicable fees.
- Commission and any applicable fees are agreed with the owner before the item is listed.
5. Optional Services
Collection, delivery, cleaning and storage services may be available and are charged separately where applicable. Any such charges will be quoted and agreed before the service is provided.
6. Payment of Sale Proceeds
- Sale proceeds are released to the owner once cleared funds have been received from the buyer.
- The owner receives the agreed amount, with the agreed commission and any applicable fees retained by Territory Sellers from the sale proceeds.
7. Owner's Responsibilities
- The owner confirms they are the lawful owner of the item (or are authorised by the lawful owner to sell it) and that the item is free of any undisclosed debts, encumbrances or security interests.
- The owner agrees to describe the item accurately, including any known faults or defects.
8. Unsold Items
If an item does not sell, it remains the owner's property and can be collected by (or returned to) the owner by arrangement. Where interest in an item is limited, we may discuss adjusting the listing or the agreed minimum price with the owner before ending the consignment.
